Purpose

  • The following scenario involves a discrimination claim brought by a student against an institution. BASED ON THE INFORMATION IN CHAPTER 7 OF THE KAPLIN AND LEE TEXT(Kaplin, W. A., & Lee, B. A. (2014). The law of higher education, student version(5th ed.). San Francisco, CA: Jossey-Bass.

Write a short paper evaluating the student’s claim based on affirmative action and discrimination in admissions. The paper must follow the format provided below and use the topics as headings in the paper.

Scenario

Green Mountain University, a public research institution, offers a graduate program in veterinary medicine. This past fall, the veterinary medical college received applications for admission from hundreds of potential students. Among those, the university rejected for admission is an applicant who is now challenging that rejection on the grounds of discrimination on the basis of race.

The veterinary medical college received an application for admission from Joan Daley. Ms. Daley graduated in the top 10% of her college class with a degree in biology and was inducted into Phi Beta Kappa. She served in a variety of leadership roles in campus organizations and was student government president. She also was an active volunteer in her community. Joan is African American.

The veterinary medical college also received an application from Bob Jones. Mr. Jones was an honors graduate from his college with a degree in biology. He served as the president of the pre-medical society at his college and worked in residential life as a resident advisor. On the weekends he regularly assists at the local animal shelter. Bob is Caucasian.

Both students have taken the requisite coursework as well as achieving high marks in their academic studies. Additionally, they have each been involved outside the classroom in a variety of organizations and activities.

Green Mountain University has determined that its veterinary medicine program historically has not attracted many African Americans and as a result the student body is predominately Caucasian. The program is evenly split between male and female students. Green Mountain University has an admissions procedure that provides a preference for African Americans in an attempt to attract more African Americans to the program and diversify the student body.

Bob was denied admission but Joan was accepted. Bob has contacted Green Mountain University and advised it that he plans to file a complaint with the EEOC alleging reverse discrimination, arguing that he is better qualified than Joan and that she was given preference based on her gender and race.

Is Green Mountain University justified in denying admission to Mr. Jones and accepting Ms. Daley as a legitimate attempt to diversify its veterinary medical program and attract more racial minorities to it?

Be sure to address all of the following issues in 2–3 pages and make sure you use the topics as subheadings:

  • Admissions policies:What are the requirements for a valid admissions policy? How do race and gender fit into these requirements?
  • Affirmative action:What is the purpose of an affirmative action program? When can a university use an affirmative action program?
  • Was Green Mountain University justified in accepting Joan Daley and rejecting Bob Jones on the basis of diversifying its student body through its admissions process?

Conclusion

The conclusion summarizes the major points of the paper and reiterates its purpose. It ties everything together in a concise manner. The conclusion is 1–2 paragraphs long.
